SB Lite Limited - Terms & Conditions of Hire
Any amendments to your hire should be agreed in writing before the
end hire date.

Terms and Conditions:
Definitions of hire:
In these conditions “Contract” means a contract for the hire of the
equipment. “Equipment” means the equipment described or any individual
item. “Hirer” refers to yourself representing the company hiring the
equipment. “SB Lite” and “SB Lite” refers to SB Lite Limited. “Hire
Charge” refers to the cost of hiring the equipment in the hire period.
PERIOD OF HIRE
1. The period of hire commences when the equipment passes from the
possession of SB Lite to the Hirer.
2. The period of hire shall continue until possession of the equipment
passes back to SB Lite or its authorised representative.
2.1 The period of hire will be stated on the start of the hire
confirmation.
2.2 Goods returned after the return date/time will be charged at 2x the daily
hire cost until the point of return. If SB Lite incurs any loss of revenue due to late return this will be passed onto the hirer.
THE EQUIPMENT
3. The equipment on hire shall remain the absolute property of SB Lite
3.1 SB Lite reserves the right to install GPS tracking devices in any
equipment and track its location at any point.
4. It is the responsibility of the Hirer to satisfy himself that upon
receipt of the equipment it is in good working order and undamaged
condition and the signature of the hire terms shall be conclusive evidence
that the Hirer has received the equipment in good working order and
undamaged condition. SB Lite will not be responsible for any defects or
deficiencies in the equipment unless an appropriate specific note has been
made on the Delivery Note and such note has been signed by the SB Lite or
its authorised representative.
5. SB Lite does not warrant that the equipment is suitable for the
particular or any purpose for which it is or may be required.
6. The Hirer shall not assign transfer or otherwise part with possession of
the equipment during the period of hire without the prior written consent
of SB Lite.
7. The Hirer shall not take or permit to be taken the equipment out of the
United Kingdom nor use or permit it to be used for any abnormal or
hazardous assignments without the prior written consent of SB Lite.
8. All equipment should be run by a competent person within a risk
assessment set out by the hirer. This includes any laser equipment. SB Lite
cannot be held responsible for any injury caused by misuse of the
equipment.
LOSS OF OR DAMAGE TO EQUIPMENT
9. Throughout the period of hire the Hirer shall be responsible for the
safe keeping of the equipment and shall be liable to SB Lite for all loss
of or damage to the equipment howsoever caused. All effects must only be
used with consumables purchased from SB Lite.
10. The Hirer shall notify SB Lite of any loss of or damage to any
equipment on hire within 24 hours of such loss or damage being sustained.
11. The Hirer shall not carry out or attempt to carry out any repairs to
damaged equipment without the prior written authority of SB Lite
12. The Hirer shall pay to SB Lite all costs incurred by it in carrying out
repairs to damaged equipment.
13. The Hirer shall pay to SB Lite the full cost of replacing any lost
equipment or any equipment which in the reasonable opinion of SB Lite is
uneconomic to repair with new equipment of the same or similar
specification to that equipment which has been lost or damaged. – Cost of
S1 Uplighter is £200inc VAT
14. During any period in respect of which the Hirer has not already paid to
SB Lite the cost of hiring any equipment which shall be lost or damaged as
mentioned above and until such time as payment shall be made to SB Lite
pursuant to conditions 12 or 13 above the Hirer shall pay to SB Lite
compensation for the loss of use of the equipment lost or damaged at a rate
equivalent to charges currently made by SB Lite for the hire of such
equipment.
15. Faliure to return the equipment will be treated as theft and the matter
will be referred to the police.
16 SB Lite will retain your card details for the duration off the hire.
Failure to return the equipment will result in the card been charged for
the full amount of the equipment retail cost as new.
INSURANCE
17. The hirer is responsible for arranging any insurance necessary for the
product. This includes public liability insurance. Whilst the product is
with the hirer they are solely responsible for any safety concerning the
product.
CANCELLATION
18. In respect of any order cancelled by the Hirer, the Hirer shall be liable to pay to SB Lite a cancellation charge not exceeding 100% of the total agreed
hire charge for the cancelled hiring.
18.1. DIY Uplighting bookings may be cancelled with 7 days of placing the booking excluding when the event is within 7 days of booking. Bookings cancelled after this will be charged a cancellation charge of 100% of the booking.
18.2 SB Lite retains the rights to cancel any hire contract without reason.
Upon doing so any equipment should be returned.
LIMITATION OF LIABILITY
19. If SB Lite for any reason is unable to provide any equipment which is
the subject of an agreement between SB Lite and the Hirer then SB Lite
shall not be liable for any loss or consequential loss suffered by the
Hirer as a result thereof.
PAYMENT
20. Payment of any monies payable to SB Lite in respect of any agreement
between the Hirer and SB Lite shall be made to SB Lite no later than 7 days
following the date on which SB Lite shall deliver an invoice to the Hirer
(and such invoice shall be deemed to have been delivered to the Hirer on
the day after which it is posted by ordinary first class post to the
address of the Hirer as notified to SB Lite) provided the payment of any
monies payable to SB Lite arising from any act or default on the part of
the Hirer (other than payment of the charge for the hire of equipment or
supply of services) shall be payable to SB Lite on demand and SB Lite
reserves the right to charge the Hirer interest on any outstanding monies
at 5% above the base rate of the HSBC Bank PLC from time to time in force.
21. On long-term hire the hirer is responsible for regular payments as set
out in the hire details. Failure to make payment will result in the
equipment been revoked by SB Lite. The person hiring the equipment is
personally liable for the cost should SB Lite go into liquidation or
administration.
22. All invoices are due for payment within 7 days of the invoice been
issued unless otherwise stated. Any outstanding beyond this period will be
referred to Daniels Silverman Limited and will be subject to a surcharge of
15% plus vat to cover the cost of collection costs incurred. This surcharge
together with all other charges and legal fees incurred will be the
responsibility of the hirer and will be legally enforceable.
23. All hires will be subject to VAT charged at the current rate.
SECURITY DEPOSIT
24. SB Lite charges a security deposit on all hires set-out on the hire
confirmation. Security deposits will be collected on the commencement of
the hire and refunded to the hirer on confirmation that all the equipment
is returned in a satisfactory condition.
DELIVERY & COLLECTION
25.All dates and times quoted by SB Lite for the delivery and collection of
equipment are approximate and SB Lite shall not be held liable for any
delay in delivery or collection howsoever caused.
26.All equipment should be collected and returned within our normal working
hours (Mon 9:30am-10:30am, Tue-Fri (9:30am-5:30pm, Sat 11am-3pm).
Additional charges may be incurred outside these hours.
INDEMNITY
27. The hirer shall at all times fully indemnify SB Lite its employee’s and
agents against all actions costs claims demands proceedings or liabilities
arising from or in connection with equipment materials or any other
services.
28. Any hirer will be personally liable for any monies owed to SB Lite
regardless of company status.
MARKETING
29. SB Lite may take pictures of your hire and use them to promote the
product and/or SB Lite.
